DRAFT FOR ATTORNEY REVIEW. NOT LEGAL ADVICE. NOT YET IN EFFECT. Version: [VERSION, e.g. 0.1-draft] | Effective date: [EFFECTIVE DATE]
Domain Registration Terms
These terms apply when you buy or renew a domain name through smallbusinessactivation.com (AgentX, LLC). They are part of the Terms of Service.
1. Who you are: the registrant
- You are the registrant. The domain is registered in your name and belongs to you, not AgentX.
- You must give accurate, current contact information, as registries require, and keep it up to date. False information can lead to suspension or loss of the domain under registry and ICANN rules.
- We submit your contact details to our registrar provider and the relevant registry only as required to register and maintain the domain.
2. Registrar and registry rules
Domains are registered through our registrar provider, Cloudflare Registrar (Cloudflare, Inc.). You agree to the registrar provider's registration terms and to the policies of the relevant registry, and to ICANN policies including the Uniform Domain-Name Dispute-Resolution Policy (UDRP). Those terms and policies are incorporated into these terms. We are an intermediary and are not the registry or ICANN. Some top-level domains have extra eligibility, pricing or renewal rules. [BUSINESS: CONFIRM LINKS AND SUPPORTED TLDS.]
3. Availability and price
- Availability is checked during your intake and checked again when you pay. If the domain is no longer available, you are automatically refunded the domain charge, and we offer alternatives.
- Price: the price you pay is our registrar's cost for the domain plus a 10% service markup, with a minimum markup of $4. The exact price, before tax, is shown before you pay. The same pricing method applies to renewals, using the registrar's cost at the time of renewal.
- Registration happens after payment is confirmed. Registrations are for the term shown at checkout.
4. Renewals
- Domains do not renew themselves in your name unless you let us charge the saved payment method. By buying a domain and saving a payment method, you authorize us to charge your saved payment method for renewals at the then-current renewal price, about 30 days before expiry.
- We email you before each renewal charge (at least 30 days, and again 7 days, before renewal) with the date, amount and how to cancel. [ATTORNEY: CONFIRM THESE NOTICE TIMINGS MEET AUTO-RENEWAL LAWS, SEE README.]
- You can turn off renewal at any time in your dashboard. If a renewal charge fails, we will email you, and if payment is not made, the domain will expire and may be lost. Expired domains may enter a redemption period with extra fees set by the registry.
- PayPal payers who cannot be charged automatically will be sent payment links before renewal.
5. Transferring out and ownership
You may transfer your domain to another registrar at any time, subject to registry rules (for example, ICANN's 60-day transfer lock after registration or a change of registrant contact, which we cannot override). Your dashboard shows the transfer-out steps and your authorization code. If you delete your account, we show you how to transfer out first. We do not hold a domain hostage over a content or hosting dispute.
6. Using your domain with your site
Pointing your domain to the site we host for you is part of publishing. You may also connect a domain you already own, with no purchase. If you move your domain or stop hosting with us, your site will stop being served at that domain.
7. Non-refundable
Domain registrations and renewals are non-refundable once completed, as stated in the Refund Policy. The exceptions are those in the Refund Policy: a domain that could not be registered is refunded automatically.
8. Prohibited uses and our rights
You must not use a domain for anything prohibited by the Acceptable Use Policy or law. Registries, registrars or courts may suspend, transfer or cancel a domain, and we may follow their instructions without liability to you.
9. Taxes and fees
Prices exclude applicable tax, which we add where required. ICANN fees are included in the price unless stated otherwise.
